Shubert of Richland, Pulaski County Missouri, being of sound and disposing mind and in good health, but knowing the uncertainty of life and being well advanced in years do hereby make ordain and establish this as my last will and testament, hereby revoking all former wills by me made. First - After my death I wish to receive Christian burial from the Methodist Episcopal Church and to be buried in my lot at the Richland Cemetery and a plain stone to be placed to mark the place of my last resting place, to be paid for from what Estate I may leave. I also want all my debts paid in full, so that no one may be the loser by my death. Second - After my debts are all paid I want my property disposed of as follows. I give to each of my children to wit, Charles H. Shubert, Henry C. Shubert, Eliza H. McIntire, Edward F. Shubert, Mary F. Agee, and George R. Shubert the sum of one dollar each and such mementoes as my wife may give to them. The ballance of my personal property, money, notes, and any other evidences of debt coming to me I leave to my beloved wife for her own use. Third – It is my wish that after my death, that my beloved wife Mary A. Shubert will continue to reside in the home we now occupy during her life, that she will keep the taxes paid up, and keep the house insured for a reasonable amount, in favor of my children the aforesaid Charles H. Shubert, Henry A. Shubert, Eliza H. McIntire, Edward F. Shubert, Mary F. Agee, and George R. Shubert and after the death of my beloved wife, Mary A. Shubert I wish the house and lot upon which it stands to wit all of block 8 Traw & Bunham addition to the city of Richland to be sold for the highest price it will bring either at public or private sale and the proceeds divided among my children aforesaid according to their respective interests, I having made some small advances to some of them, said advances to be brought into “Noloh Pot” and then equitably divided. Fourth – I hereby appoint my beloved wife Mary A. Shubert sole executor of this my last will and testament during her life and after her death I wish my oldest son Charles H. Shubert to settle up all the ballance of my estate each of said executors to serve without bond. In witness whereof I have hereunto subscribed my name this 12th day of November 1906 Garrett B. Garrett B. Shubert to be his last will and testament in the presents of us who,
at his request and in the Sam I. Ellis Richland Mo. Proof of Will Be it remembered, that on this 7th day of January A.D. 1907 before me Joe McGregor, Judge of the Probate Court, held in aced for the county and state aforesaid, personally appeared Sam I. Ellis & D.S. Bohanon who are the subscribing witnesses to the will annexed of Garrett B. Shubert deceased, and being by me duly sworn, disposed and said that the said Garrett B. Shubert the testator subscribed the same in their presence, and published & declared said will or instrument of writing to be his last Will and Testament, and that at time of signing the same he the said testator was of sound and disposing mind and more than twenty one years of age, and that said deponents attested said will as witnesses thereunto by subscribing their names on the same in the presents of the testator and of each other and at the request of said testator. Sam I. Ellis Sworn to and subscribed before me this 7th day of January. L.S. Sate of Missouri I, Joe McGregor Judge of the probate Court of Pulaski County, State of Missouri having examined the foregoing instrument, purporting to be the last Will of Garrett B. Shubert deceased, and signed by him the said Garrett B. Shubert and having heard the testimony of Sam I. Ellis and D.S. Bohanon subscribing witnesses, thereto, in relation to the execution of the same, do declare and adjudge said instrument to be the last Will and testament of the said Garrett B. Shubert deceased late of Pulaski County Missouri, and the same is hereby admitted to Probate. In witness I have hereunto set my hand and affixed the Seal of said Court at office in Waynesville Mo. this 7th Day of January. Joe McGregor L.S.
